PREPARING A-76 TECHNICAL PROPOSAL SUBMITTAL REQUIREMENTS

A negotiated procurement allows the Government to acquire information to assure the offeror can, and get some insight if the offeror will, do the job satisfactorily.  The Technical Proposal submittal requirements should be unique to the specified service.  Additional information concerning experience, the offeror's organization chart, corporate financial assets, and a list of key on-site personnel are fairly standard for all negotiated procurements.  In an A-76 study, the questions are vital to assuring only commercial companies who can specifically demonstrate a capability to provide full performance immediately upon the contract start are selected.  If they, or the Government MEO for that matter, can not demonstrate such capability, then those offerors should be excluded from any further consideration.  If only the Government MEOís proposal is considered acceptable, the function is retained in-house and the A-76 study is closed.  The following describes the steps to develop good technical proposal submittal requirements.

A. Good technical proposal submittal requirements should identify if the offeror actually understands how to manage a potential contract operation. The Technical Proposal should require a written presentation on such issues as

  1. Given the contract requirements and the referenced Government instructions. what types of employees, their experience and educational background, does the offeror intent to staff the contract?  Given that many of the current Government employees will be placed in other Government positions and unavailable for contract employment, what assurance can the offeror provide that offered types of employees will be immediately available upon start of the contract?
  2. What types, and how many, employees will be assigned to the various contract services or functions?
  3. How will the contractor receive, process, and execute work requirements?
  4. How will the contractor schedule the work, both fixed-priced and indefinite quantity.
  5. How will the contractor execute indefinite quantity work and not divert employees from the ongoing fixed-price work?
  6. What special tools, equipment, and vehicles are required?
  7. Where will the contractor acquire supplies?  What types of supplies will the contractor have immediately on hand for emergencies?

B. Developing the Technical Proposal Submittal Requirements

The Technical Proposal submittal requirements should not be general; they should be specific to the contract requirements. For instance, a Technical Proposal submittal requirement for family housing maintenance service calls would be:

SERVICE CALLS

  1. What will the staffing be, in full time equivalents (FTEs), for this major service area?  Show the types of tradespeople to be employed and describe their level of skill.  Explain the rationale used to determine the number and types of FTEs.  Demonstrate those types of employees will be available immediately upon start of the contract.
  2. Describe the equipment that will be dedicated to this functional area.  How will it be acquired, maintained, and stored/parked?
  3. Describe the proposed method of managing this functional area.  Describe how the service call work will be received, assigned to an employee, scheduled, etc.
  4. Specifically describe how you will handle service call accomplishment when the resident is not home.  Do not simply refer to the specification.
  5. Describe how you will respond to emergency service calls after normal working hours.

C. Evaluating the Technical Proposal.

To properly evaluate the submitted proposals, the Technical Evaluation Team should have specific criteria upon which to rate a submittal. Working from a common basis of evaluation, such a team could quickly form a team consensus with a minimum of effort and a very supportable conclusion and rating. For the service call example, the following evaluation standard could be used.

D. Rating the Technical Proposal

Given such an approach, it would be relatively easy for the Government to exclude an inadequate offeror from the A-76 competition.  To remain in the A-76 competition, an offeror must achieve at least an "Acceptable" rating.  If using a "Best Value", negotiated procurement solicitation, an offer would almost have to score "EXCEPTIONAL" to remain in the competition.  The Technical Proposal submittal requirements are the Governmentís best safe guard against having to award a contract resulting from an A-76 to a low bidding commercial offeror.  Chances are, an offeror would be unable to support a low bid, if he/she had to respond to such technical proposal submittal requirements as shown in the above example.  If no offeror passes the Technical Proposal evaluation, the A-76 study will result in an in-house decision
